These Terms of Service ("Terms") govern your access to and use of our data analytics services ("Services"), which provide insights into your Jobber CRM account through API access to your Jobber account. By using our Services, you agree to these Terms. If you do not agree, please do not use our Services. 2. Services Overview Crew Insight offers data analytics tools that integrate with Jobber CRM accounts. Our Services include: Data Integration: Connecting to your Jobber account via API access. Analytics and Insights: Providing reports and insights based on the data retrieved from your Jobber account. Support: Offering support and assistance related to our Services. 3. Access and Use of Services 3.1 Eligibility You must be at least 18 years old or have the consent of a parent or guardian to use our Services. By using our Services, you represent and warrant that you meet these requirements. 3.2 Account Registration To use our Services, you may need to create an account and provide certain information. You agree to provide accurate, complete, and current information during the registration process and to update this information as necessary. 3.3 API Access You authorize Crew Insight to access your Jobber account via API access to retrieve data necessary for providing our Services. You are responsible for maintaining the confidentiality of your Jobber credentials and any other security measures related to your account. 3.4 Usage Restrictions You agree not to: Use the Services for any unlawful purpose or in violation of any applicable laws or regulations. Interfere with or disrupt the operation of the Services or servers. Attempt to gain unauthorized access to any system or network associated with our Services. Use the Services to collect or harvest data without permission. 4. Intellectual Property 4.1 Ownership All content, software, and other materials provided through the Services are owned by Crew Insight or its licensors and are protected by intellectual property laws. You do not acquire any ownership rights in the Services or any content by using them. 4.2 License Subject to these Terms, Crew Insight grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your internal business purposes. 5. Data Privacy and Security 5.1 Data Collection We collect and use data as described in our
Privacy Policy. By using our Services, you consent to the collection, use, and sharing of your data in accordance with our Privacy Policy. We use PostHog, a product analytics platform, to collect data about how users interact with our services. Our total liability for any claim related to the Services will be limited to the amount you paid for the Services in the six months preceding the claim. 9. Indemnification You agree to indemnify, defend, and hold harmless Crew Insight, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services, your breach of these Terms, or your violation of any law or regulation. 10. Changes to Terms We may modify these Terms at any time. We will notify you of any significant changes, and your continued use of the Services constitutes your acceptance of the revised Terms. 11. Governing Law and Dispute Resolution 11.1 Governing Law These Terms will be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of laws principles. 11.2 Dispute Resolution Any disputes arising out of or related to these Terms or your use of the Services will be resolved as follows: For Users Located in Canada: Disputes will be resolved through binding arbitration in Vancouver, British Columbia, in accordance with the Arbitration Act of British Columbia. The arbitration will be conducted by a single arbitrator selected in accordance with the rules of the British Columbia International Commercial Arbitration Centre (BCICAC). For Users Located Outside Canada: Disputes will be resolved through binding arbitration in Vancouver, British Columbia, in accordance with the Arbitration Act of British Columbia. The arbitration will be conducted by a single arbitrator selected in accordance with the rules of the International Chamber of Commerce (ICC). The language of the arbitration will be English. Each party will bear its own costs and expenses related to the arbitration. 12.
